IMPORTANT: PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ANY WORK COMMENCES. YOUR SIGNATURE CONFIRMS YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

DMC Diagnostic and Tuning Ltd provides performance tuning and diagnostic services ("the Services"). The Customer acknowledges that vehicle modification inherently involves risks and potential consequences that differ from standard vehicle maintenance.

1. Vehicle Condition and Maintenance (Customer Responsibility)

The Customer warrants that the vehicle presented to DMC Diagnostic and Tuning Ltd is in sound mechanical condition, well-maintained according to the manufacturer's recommendations (including fluid levels, timing belt/chain maintenance), and is fully roadworthy.

• Diagnostic Checks: We will perform initial visual and diagnostic checks, but these are not exhaustive mechanical inspections of internal components (e.g., turbo, engine internals, clutch, gearbox).
• Pre-existing Faults: If our diagnostics reveal pre-existing faults or issues, we will advise on necessary repairs before tuning. The Customer accepts full responsibility for any issues arising from known or unknown underlying faults. DMC Diagnostic and Tuning Ltd, reserve the right to refuse the right for tuning based on our findings.

2. Assumption of Risk and Limitation of Liability

The Customer accepts and assumes all risks associated with performance tuning and modifications. The Customer acknowledges that increasing engine performance places additional stress on all vehicle components, which may reduce their lifespan or cause failure.

DMC Diagnostic and Tuning Ltd shall not be held liable for any mechanical, electrical, or incidental failures, damage, or financial losses occurring during or after the tuning process, except in cases of proven negligence by DMC Diagnostic and Tuning Ltd.

We cannot exclude liability for death or personal injury caused by our negligence, nor can we exclude liability for breach of the consumer's statutory rights under UK law. Our total liability for other losses shall not exceed the charges paid for the Services rendered.

3. Legal, Warranty, and Insurance Implications

The Customer is solely responsible for ensuring the modified vehicle complies with all UK laws and regulations.

• Manufacturer Warranty: Modifications or custom ECU software will likely invalidate the original vehicle manufacturer's warranty. The Customer accepts this risk.
• Insurance: It is the Customer's express responsibility to inform their insurance provider of all modifications. Failure to do so may invalidate the Customer's insurance policy, which is a criminal offence.
• Road Legality & Emissions: The Customer confirms their vehicle will remain compliant with all MOT and UK emissions standards (e.g., Road Traffic Act 1988).
  • Off-Road Use Only: If the Services involve the removal or deactivation of emissions-related systems (e.g., DPF, EGR, AdBlue delete), the Customer declares the vehicle will be used strictly for off-road/motorsport use only and will not be driven on UK public roads.

4. Software and Performance Guarantees

• Software Warranty: DMC Diagnostic and Tuning Ltd guarantees the integrity of the installed software file/remap against corruption for the lifetime of the vehicle ownership. Unless the installed file/remap has ben augmented without out our prior consent.
• Performance: Quoted performance gains or fuel efficiency improvements are estimates only. Actual results may vary depending on the vehicle's condition, maintenance, and environmental factors. No specific results are guaranteed. Specific Results can be obtained via Dyno Road runs and or Static Dyno testing.
• Refunds: Once the remapping software has been successfully installed and the vehicle is running as expected, no refunds will be offered.
